Welcome to SparkShot. By using our service, you agree to these Terms of Service. Please read them carefully.
1. Service Description
SparkShot is an AI-powered photo booth platform that allows event organizers to create events where participants can take photos that are transformed using artificial intelligence. The service includes event creation, AI photo transformation, shared galleries, custom themes, and overlays.
2. Account & Eligibility
You must be at least 16 years old to create an organizer account. By creating an account, you confirm that the information you provide is accurate and that you are authorized to use the email address provided. You are responsible for maintaining the security of your account.
3. Event Organizer Responsibilities
As an event organizer, you are responsible for: (a) informing all participants that their photos will be processed by AI; (b) obtaining necessary consent from participants, especially minors' legal guardians; (c) ensuring your custom themes and overlays do not contain illegal, offensive, or infringing content; (d) complying with applicable laws regarding photography at your event.
4. Participant Consent & Image Rights
By taking a photo through SparkShot, participants consent to: (a) their photo being processed by AI to generate a transformed version; (b) both the original and AI-generated photos being displayed in the event's shared gallery visible to all event participants; (c) other participants viewing and downloading photos from the gallery. Participants can request removal of their photos by contacting the event organizer or SparkShot directly.
5. AI-Generated Content
Photos are transformed using third-party AI services. While we apply safety filters and prompt restrictions, we cannot guarantee the output of AI models. We are not liable for unexpected or undesirable AI-generated content. AI transformations preserve facial features but alter the background and atmosphere according to the selected theme.
6. Data Processing & Storage
Original and AI-generated photos are stored on secure cloud infrastructure. Photos are associated with the event and the participant's first name (no account required for participants). We do not sell or share photos with third parties beyond what is necessary to provide the service (AI processing). See our Privacy Policy for detailed information.
7. Tokens & Payments
AI photo generation consumes tokens. New accounts receive free tokens. Additional tokens can be purchased. Tokens are non-refundable except where required by law. We reserve the right to adjust token pricing and consumption rates.
8. Prohibited Uses
You may not use SparkShot to: (a) generate content depicting violence, nudity, or illegal activities; (b) process photos of individuals without their knowledge or consent; (c) use the service for surveillance or identification purposes; (d) attempt to bypass safety filters or prompt restrictions; (e) resell or commercially redistribute the service.
9. Limitation of Liability
SparkShot is provided "as is." We do not guarantee uninterrupted service or specific AI output quality. To the maximum extent permitted by law, our liability is limited to the amount you have paid for tokens in the preceding 12 months. We are not liable for: data loss due to service disruption, AI-generated content that may be offensive or inaccurate, unauthorized access resulting from your failure to secure your account.
10. Termination
We may suspend or terminate accounts that violate these terms. Upon termination, your data (events, photos, themes) will be deleted within 30 days. You may delete your account at any time by contacting us.
11. Modifications
We may update these terms at any time. Continued use of the service after changes constitutes acceptance. We will notify registered users of significant changes via email.
12. Governing Law
These terms are governed by French law. Any disputes shall be submitted to the competent courts of France.
